Terms and Conditions: In-store Home Delivery

  1. This sales order is a binding contract between the customer/customers named on the order and Hill Giftware Ltd who trade as Baytree Interiors.
  2. It is the customer’s responsibility to check all the details on the order including delivery address, contact numbers, product and payment details and delivery details. Baytree Interiors will not accept liability for any costs arising from errors on this order.
  3. Cancellations on this order will be accepted with no penalty charge by 12pm the day after the order is placed (including weekends and bank holidays). In the event of cancellation after this period but before the delivery takes place, Baytree Interiors will apply a charge of 20% of the total order value to cover our costs in taking and processing the order.
  4. No cancellation will be accepted after the goods ordered on this order have been delivered, in whole or part, for reasons not covered by the current UK and European statutory consumer rights.
  5. Payment must be made in full on the day of the order unless if a credit agreement has been signed .
  6. It is the customer’s responsibility to ensure that all goods ordered on the order will fit into the room of choice and all access points to this room. Should the order be canceled, point 3 will apply. Should a substitute product be required the additional delivery will be charged in full.
  7. Should Baytree Interiors be required to hold an order for a customer, the first 4 weeks will be free of charge, thereafter the customer will be required to pay a 1% charge of the total order value per week of holding the item.
  8. All calls into our Customer Service team may be recorded for quality and training.
  9. Baytree Interiors’ liability does not cover product or delivery failures due to factors beyond our control, such as bad weather, traffic condition, etc.
  10. Baytree Interiors’ liability does not extend beyond the United Kingdom mainland.
  11. Baytree Interiors’ liability does not extend to subsequent owners of the goods if they are sold or given away by the named customer/customers.
  12. Once your order has been delivered in part or whole, we have a no returns policy. We do offer an exchange or credit note service, should you wish to return your item within 14 days. Proof of purchase will be required.
  13. All title, ownership and risk to the ordered products will pass to you when they have been delivered to you. Once the products have been delivered to you they will be held at your own risk and we will not be liable for them.
  14. All sizes quoted are approximate and all our products are manufactured within the standard industry measurement tolerances.
  15. If any provision contained in these terms and conditions is considered by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other terms and conditions which shall remain in full force and effect.
  16. Our staff have a right to work in a non-threatening environment at all times. We reserve the right to refuse sale of any products, services and/or contact with any individual or company who displays threatening behaviour towards our staff.
  17. A failure by us to exercise or enforce any right conferred upon us by these terms and conditions shall not be deemed to be a waiver of such right or operate so as to bar the exercise or enforcement thereof at any subsequent time or times.
  18. Consumer statutory rights are not affected by these terms.
  19. You agree to indemnify, defend and hold us harmless from any liability, loss, claim and expense (including reasonable legal fees) related to your breach or misuse of these Terms and Conditions
